1. General Provisions
These Terms of Service govern the use of the Dimdom web portal available at dimdom.pl.

2. Definitions
- Service/Portal - the Dimdom web platform for publishing and browsing real estate listings
- User - any person using the Service, whether registered or unregistered
- Account - a set of resources and settings created for a User in the Service
- Listing - a publication concerning the sale or rental of a property
- Featured Listing - a paid service that increases the visibility of a listing
3. Scope of Services
The Service offers the following features:
- Browsing real estate listings (available without registration)
- Publishing sale and rental listings (requires registration)
- Managing your own listings
- Purchasing featured listings for increased visibility
- Contacting advertisers
4. User Obligations
The User agrees to:
- Provide accurate and up-to-date information
- Publish listings that accurately reflect reality
- Not publish content that violates the law or good practices
- Respect copyright of any photos uploaded
- Promptly remove outdated listings
- Keep login credentials confidential
5. Listing Publication Rules
Listings must relate to real properties available for sale or rental. Publishing test listings, duplicates, or misleading listings is prohibited.
Each listing is valid for 45 days from the date of publication, after which it may be extended.
The Administrator reserves the right to moderate, edit, or remove listings that violate these Terms.
6. Payments and Billing
Publishing listings is a paid service. The price depends on the chosen validity period. Additionally, a featured listing service is available that increases the visibility of your offer.
Service prices are available in the listing publication panel. All prices are quoted in Polish zloty (PLN) including VAT.
Payments are processed through a secure online payment system. A VAT invoice is issued automatically for users who have filled in their invoicing details.

7. Prohibited Content and Behavior
The following are prohibited:
- Publishing content that is unlawful, offensive, or discriminatory
- Posting false information about properties
- Using the Service for activities contrary to its purpose
- Attempting unauthorized access to the Service's systems
- Collecting other users' data without their consent
- Publishing content that infringes copyright
8. Termination of Use
A User may delete their account at any time by contacting the administrator.
The Administrator reserves the right to suspend or delete an account in the event of a breach of these Terms, after prior notification to the User.
9. Liability
The Service acts as a platform facilitating contact between users. The Administrator is not a party to any transactions concluded between users and is not liable for their outcome.
The Administrator does not verify the accuracy of information contained in listings and is not responsible for their content.
Users conduct transactions at their own risk and should exercise due caution.
10. Final Provisions
The Administrator reserves the right to amend these Terms. Users will be notified of significant changes by email or via a notice in the Service.
Matters not covered by these Terms are governed by Polish law.
All disputes shall be resolved by the court having jurisdiction over the Administrator's registered seat.
11. Personal Data Protection
11.1 Data Controller

11.2 Processing purposes and legal bases
Personal data of Users is processed for the following purposes:

11.3 User Rights
Every User has the right to:
- access their personal data (Art. 15 GDPR)
- rectification of data if inaccurate or incomplete (Art. 16 GDPR)
- erasure of data ("right to be forgotten") — provided no other legal basis for processing exists (Art. 17 GDPR)
- restriction of processing in certain cases (Art. 18 GDPR)
- data portability in a structured format (Art. 20 GDPR)
- object to processing based on legitimate interest (Art. 21 GDPR)
- withdraw consent at any time — without affecting the lawfulness of processing prior to withdrawal
To exercise the above rights, please contact the Administrator at: kontakt@dimdom.pl. Requests will be processed without undue delay, no later than 30 days from receipt.
Users also have the right to lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw, www.uodo.gov.pl) if they believe that their data processing violates the GDPR.
11.4 Data Recipients
Users' personal data may be shared with:
- the payment operator — dpay.pl — only to the extent necessary for payment processing
- hosting and technical infrastructure providers — under data processing agreements
- public authorities — only when required by law
The Administrator does not sell Users' personal data or share it with other entities for marketing purposes without explicit User consent.
11.5 Cookies
The Service uses cookies for proper platform operation, traffic analysis, and content personalisation. Detailed information about the use of cookies is available in the Cookie Policy at dimdom.pl. Users can manage cookie settings in their web browser.
The full Privacy Policy is available at dimdom.pl/privacy. The Privacy Policy supplements these Terms with regard to personal data protection.
12. Right of Withdrawal
12.1 Who has the right of withdrawal
The right to withdraw from a distance contract is available exclusively to Users who are consumers within the meaning of Art. 22¹ of the Polish Civil Code, i.e. natural persons performing a legal act not directly related to their business or professional activity.
The right of withdrawal does not apply to entrepreneurs — persons conducting business activity who use the Service in connection with that activity (e.g. real estate agencies, developers).
12.2 Deadline and method of withdrawal
A consumer may withdraw from the contract without giving any reason within 14 calendar days from the date of its conclusion (i.e. from the date of service activation or payment).
To exercise the right of withdrawal, the User should inform the Administrator of their decision by means of an unambiguous statement sent:

To meet the deadline, it is sufficient to send the statement before its expiry.

12.4 Effects of withdrawal and refund
In the event of effective withdrawal from the contract, the Administrator shall refund all payments received from the User without undue delay, no later than 14 days from the date of receipt of the withdrawal statement.
The refund shall be made using the same payment method used by the User, unless the User has expressly agreed to a different solution.
12.5 Exception — service already performed
In accordance with Art. 38(13) of the Polish Consumer Rights Act, the right of withdrawal does not apply to contracts for the provision of services if the Administrator has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that they would lose the right of withdrawal upon full performance by the Administrator.
In practice, this means: if the listing has already been published and was publicly visible, the right of withdrawal may not apply. The Administrator will inform the User of this fact before service activation.
13. Complaints
13.3 What a complaint should contain
For efficient processing of complaints, we recommend including:
- first name, last name and email address associated with the account
- description of the problem — what happened, when, and under what circumstances
- expected resolution (e.g. listing restoration, refund)
- optionally: screenshots or other materials confirming the problem
13.4 Processing deadline
The Administrator shall process the complaint within 14 calendar days from the date of receipt. The response will be provided via the same channel through which the complaint was submitted, or to the User's email address.
If the complaint requires additional explanations or documents, the Administrator will inform the User within 14 days and set a new deadline, not exceeding 30 days from the original submission.
Failure by the Administrator to respond within 14 days of receiving a complaint submitted by a consumer is deemed acceptance of the complaint — in accordance with Art. 7a of the Polish Consumer Rights Act.
13.5 Out-of-court dispute resolution
Users who are consumers may use out-of-court complaint and claim resolution methods, in particular:
- mediation conducted by the relevant Provincial Trade Inspection Inspectorate
- proceedings before permanent consumer arbitration courts operating at the Trade Inspection
- the ODR (Online Dispute Resolution) platform available at: ec.europa.eu/consumers/odr
The use of the above dispute resolution forms is voluntary and requires the consent of both parties. The Administrator is willing to participate in out-of-court consumer dispute resolution.
